Liability Waiver
Participants in the Dental Savings Program (Program) acknowledge that there is a possibility that health care professionals and others providing services in connection with the Program can cause injury and damage to a Participant. The Participant understands and accepts such risk. Gallagher Koster, a division of Arthur J. Gallagher Risk Management Services, Inc. and its Program contractor, Basix, disclaims any warranty, expressed or implied, regarding the quality, nature or kind of services to be rendered to a Participant by any health care professional providing services under the Program. Gallagher Koster, a division of Arthur J. Gallagher Risk Management Services, Inc. and/or Basix shall not be responsible or liable to the Participant under any circumstances for any injury or damage sustained by the Participant as a result of services provided under the Program by any health care professional or other provider. Gallagher Koster, a division of Arthur J. Gallagher Risk Management Services, Inc. and/or Basix shall not be liable for any damages, including without limitation, direct, indirect, consequential, incidental, special or exemplary damages arising out of or related to the provision of services to the Participant by a health care professional or other provider under the Program.
